Under 35? A Will Might Matter More Than You Think

There’s a common misconception that Wills are something you sort later in life: once you’re older or own multiple properties.

But a Will isn’t about age. It’s about control. It gives you the power to decide what happens to your assets, who handles your affairs, and how the people you care about are supported if the unexpected happens.

Susan Hall, Head of our Wills and Probate team at Myers & Co, explains why some of the most important decisions you’ll ever make shouldn’t wait. A Will offers clarity, certainty and protection, especially for people who assume they’re “too young” to need one.

What happens to your partner if you’re not married and you die without a Will?

This is the part most people don’t realise.

If you live with your partner but you’re not married or in a civil partnership, they don’t automatically inherit without a valid Will. Even if you’ve lived together for years or share all financial responsibilities, the law doesn’t recognise cohabitees under intestacy rules.

This could mean:

A Will is the simplest way to make sure the person you share your life with is legally protected, not left vulnerable to assumptions or conflict.

How do intestacy rules decide who gets what, and why might that be a problem?

If something happens to you without a Will, the law decides who inherits.

These rules follow a strict order, and they can deliver outcomes very different from what you would have chosen.

For example, if you have a spouse or civil partner and children, the law provides:

If this isn’t what you want? A Will is the only way to ensure your wishes are followed.

Why naming guardians for children in your Will is crucial

If you have children under 18, your Will is where you legally record who you would want to care for them if you couldn’t.

Without this, you risk:

A clear, legally valid Will ensures your children are cared for by the people you trust most.

Your home may cause complications, especially if it’s co-owned

For many people under 35, their most valuable asset is their home. How it’s legally owned affects what happens after you die.

Many couples assume ownership works one way, but the legal structure often tells a different story.

When you make or update your Will with Myers & Co, we check how your property is held so your estate plan works exactly as you intend.

Digital assets matter too

Today, much of your life, and value, exists online.

Your digital estate might include:
